Like many other states, Florida has a mandatory arrest policy for domestic violence cases. If you or your spouse calls 911 during a domestic dispute, someone is going to jail.

In a typical domestic violence case, the parties involved change their minds and try to undo the charges. However, by then it may be too late. Once formal criminal charges are filed, it is much harder to obtain a dismissal, even if your spouse wants to drop charges. In fact, once charges have been brought, it is no longer at the discretion of your spouse whether or not to drop charges, that decision belongs solely to the prosecutor.

As former prosecutors, we understand the mindset of the prosecutor assigned to your case.  Even with an uncooperative victim, the prosecutor may choose to continue to move forward with the case for the following reasons:

 
·         Independent observations by law enforcement or witnesses.  For example, witnessing the incident itself or witnessing bruising or injury on the victim's body
·         911 Call:  The Prosecutor has access to 911 calls and will subpoena the tape and dispatcher in order to play the 911 tape to the jury
·         Admissions or incriminating statements by you the accused
·         DNA evidence
